Terms of Service

1. Service

AccuPredix provides cloud-based demand forecasting including model competition, quantile forecasts, integrations, collaboration, and related features described on our website and documentation. Features vary by subscription tier.

2. Eligibility & accounts

You must be at least 18 and authorised to bind your organisation. You are responsible for account credentials and all activity under your account. Provide accurate registration information and notify us promptly of unauthorised access.

3. Acceptable use

• Do not violate law, infringe third-party rights, or upload malicious code
• Do not attempt unauthorised access, probe, or disrupt the service
• Do not resell or sublicense except as permitted on Agency plans
• Do not use the service to generate unlawful forecasts or discriminatory decisions prohibited by law

4. Customer data

You retain ownership of data you submit. You grant AccuPredix a limited licence to host, process, and display that data solely to provide the service. You represent that you have the rights and lawful basis to submit data, including personal data of your employees or end customers where applicable.

5. Subscriptions & billing

Paid plans renew monthly unless cancelled before the renewal date. Fees are exclusive of taxes unless stated. Usage limits, workspace caps, and feature gates apply per tier and may change with notice. Downgrades may lock excess workspaces, members, or API keys until within plan limits. Freemium tier limits apply as published at signup.

6. Free trial & Freemium

We may modify or discontinue free tiers at any time with reasonable notice. Free tiers are provided without SLA guarantees.

7. Forecast outputs & disclaimers

Forecasts, intervals, and recommendations are statistical estimates based on data you provide. They are not guarantees of future demand. You are responsible for business decisions made using outputs. AccuPredix is not liable for inventory, revenue, or operational outcomes resulting from reliance on forecasts.

8. Intellectual property

AccuPredix owns the platform, models, software, documentation, and branding. You receive a non-exclusive, non-transferable right to use the service during your subscription. Feedback may be used to improve the product without obligation to you.

9. Confidentiality & security

Each party will protect the other's confidential information with reasonable care. We implement security measures described in our documentation but cannot guarantee uninterrupted or error-free operation.

10. Suspension & termination

We may suspend or terminate access for material breach, non-payment, or abuse. You may cancel at any time through account settings. Upon termination, export windows and deletion timelines follow our Privacy Policy and DPA.

11. Limitation of liability

To the maximum extent permitted by law, AccuPredix is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability for any claim arising from these Terms is limited to fees paid by you in the twelve months preceding the claim. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

12. Indemnity

You will indemnify AccuPredix against claims arising from your data, your use of the service in violation of these Terms, or violation of applicable law, except to the extent caused by our gross negligence or wilful misconduct.

13. Governing law

These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Courts in Amsterdam shall have exclusive jurisdiction for B2B disputes unless we agree otherwise in writing.

14. Changes

We may update these Terms. We will post changes on this page and, for material changes, provide notice by email or in-app banner where appropriate. Continued use after the effective date constitutes acceptance.
